Domestic Assault vs. Assault
Reyes Law has 25 years of experience in all kinds of assault and battery issues, but Domestic Assault is the most common, the ramifications of pleading to a Domestic Assault versus pleading to an Assault are very different and Domestic Assault has worse ramifications. You definitely need to have an attorney in this kind of case as there are different defenses and ramifications for each. To start, an assault in Iowa has many legal definitions. Two of the most common definitions are listed below:
- Any act which is intended to cause pain or injury to, or which is intended to result in physical contact which will be insulting or offensive to another, coupled with the apparent ability to execute the act. (In other words, this means any intentional action that would cause someone pain or did cause someone to offensively touch another person.)
- Any act which is intended to place another in fear of immediate physical contact which will be painful, injurious, insulting, or offensive, coupled with the apparent ability to execute the act. (In other words, this means any overt action that would cause a reasonable person fear of being injured or fear of being touched inappropriately). (I should note that the person making the offensive or injurious action must be in the immediate vicinity of the alleged victim.)
